1. Introduction

Welcome to Majestic Silk. We are registered with the Chamber of Commerce under registration number 92981526, and our Tax ID is NL004990518B97. These Terms and Conditions have been established to define the rights and obligations of both Majestic Silk and our customers, ensuring transparency in our business transactions. By placing an order through our website, you agree to be bound by these Terms and Conditions. We recommend that you carefully review them before making a purchase.

2. Definitions

  1. Company: Refers to Majestic Silk, registered at the Chamber of Commerce under registration number 92981526.
  2. Customer: Any individual or legal entity that places an order for products with Majestic Silk.
  3. Products: Refers to all items offered by Majestic Silk for sale, including but not limited to silk flowers, luxury decor items, and any related accessories.
  4. Order: A purchase request made by the Customer for one or more Products from Majestic Silk through the Company’s website or other sales channels.
  5. Agreement: The binding contract between the Company and the Customer, established once an Order is confirmed by the Company.
  6. Fire Retardant: A special treatment applied to certain Products to reduce the risk of ignition and slow the spread of fire, meeting specific safety standards.
  7. Real Touch: A term used to describe Products that are designed to feel and appear extremely lifelike, closely mimicking the texture and appearance of real flowers or plants.
  8. Shipping Date: The designated date each month on which Products are shipped from Majestic Silk to the United States. The Company typically has one primary shipping date per month for US deliveries. Orders placed after this date will be scheduled for the next month’s shipment unless Express Shipping is selected.
  9. Express Shipping: A premium shipping option that guarantees delivery of Products within 48 hours to the United States, available at an additional cost. This service is available to Customers who require faster delivery outside of the regular monthly shipping schedule.
  10. Deadline: The final day by which Orders must be placed to be included in the upcoming Shipping Date. All Orders must be submitted at least 5 days prior to the Shipping Date to ensure on-time shipment. Orders placed after this Deadline will be scheduled for the next month’s shipment or require Express Shipping for faster delivery.
  11. Business Days: Refers to the working days of the Company, Monday to Friday, excluding weekends and public holidays.

3. Applicability

These Terms and Conditions apply to all offers, orders, and agreements made through the website of Majestic Silk or any other sales channels. By placing an order, the Customer agrees to these Terms and Conditions. Deviations from these Terms are only valid if explicitly agreed to in writing by the Company. If any provision of these Terms and Conditions is declared invalid or void, the remaining provisions shall remain fully in effect.

4. Offer and Agreement

Most offers from Majestic Silk are made through our webshop or website. For customers seeking a more tailored offer, these are provided via email. An Agreement is established once the Customer clicks “confirm order” on the website or accepts a written offer provided by the Company. Upon confirmation of the order, payment is required immediately.

Prices are subject to change and may fluctuate, particularly in cases where additional shipping or air freight services are requested. Majestic Silk reserves the right to adjust prices based on changes in logistics or shipping costs.

5. Prices and Payment

The prices displayed in our webshop are based on full boxes of products. Each product page clearly indicates the number of items per box, typically 6, 12, or 24 pieces. All prices are exclusive of VAT, which will be added at checkout. We understand this may be challenging for some customers, but it allows for accurate pricing.

We accept payments via credit card, bank transfer, and Shopify Pay, covering all major payment options.

For new customers, payment terms are pay on delivery. As the relationship develops, it may be possible to extend the payment period to 14 days. If payments are delayed, we are required to notify our collection agency, who will prepare a report on the business with the overdue payment.

6. Delivery and Shipping

Majestic Silk offers two delivery options:

  1. Carrier Shipping: Orders shipped via a carrier typically arrive within 2 to 5 business days. This is a faster, but more costly, option. It ensures quicker delivery to the destination.
  2. Sea Freight: For a more cost-effective option, sea freight is available, though it has a longer delivery time of up to 40 days. This method is more affordable but takes significantly longer.

Every month, we offer a 5% discount on selected products on a specific day. This discount helps us consolidate shipments, thereby reducing transport costs when larger volumes are shipped together.

If a delivery via carrier is delayed, a discount may be offered as compensation. However, for sea freight deliveries, we account for a variance of -5% or +5% in the delivery timeframe. A tracking code will be provided for every order, giving accurate updates on when your products are expected to arrive.

In the case of delays caused by circumstances beyond the control of Majestic Silk, we cannot offer any compensation for the delay.

For return shipments, FedEx will be used. The return shipping costs are the responsibility of the Customer unless otherwise agreed upon. Return requests must be made within 72 hours of receiving the delivery.

7. Right of Withdrawal and Return Policy

Customers may cancel their order within 24 hours of order confirmation without any charge. After this period, a 10% cancellation fee will apply for any cancellations.

Products can be returned for the following reasons:

  • Irreparable damage that renders the product unusable.
  • Incorrect product delivered that cannot serve as a replacement for the missing product.

Please note that only complete boxes of products can be returned. We do not accept returns for boxes where individual flowers or items have been removed or used.

All returns must be reported to Majestic Silk, who will coordinate with FedEx to arrange the pickup of the products. A handling invoice will be issued to cover any costs incurred in the return process.

8. Warranty and Conformity

Majestic Silk offers a 1-year warranty on all of our products. This warranty applies only if the products are properly cared for, which includes:

  • Dusting twice per month.
  • Ensuring the products are not exposed to outdoor conditions for longer than 12 hours.

If a product does not meet expectations or is found to be defective within the warranty period, Majestic Silk will work with the Customer to find an appropriate solution. For assistance, please refer to the contact details listed on our website.

9. Liability

Majestic Silk is not liable for any damage resulting from improper use of our products. The products we sell are of the highest quality, and we expect customers to handle them with care. The warranty is void if the products are used inappropriately or not according to the guidelines provided.

In the event of a complaint, Majestic Silk will always request photographic evidence to verify the issue.

Furthermore, Majestic Silk is not liable for delays caused by external factors beyond our control, such as natural disasters, including but not limited to earthquakes, floods, or storms.

Majestic Silk respects the privacy of its customers and is committed to protecting any personal information provided during the order process. We do not actively store customer data beyond what is necessary to complete and deliver the order. Furthermore, under no circumstances do we sell or share customer data with third parties for commercial purposes.

11. Applicable Law and Disputes

All agreements and transactions made with Majestic Silk are governed by the laws of the Netherlands. In the event of any disputes arising from or in connection with these Terms and Conditions, the parties agree to submit such disputes to the exclusive jurisdiction of the High Court of The Hague, unless otherwise required by mandatory law.

By entering into any agreement with Majestic Silk, the Customer acknowledges and accepts that Dutch law shall apply to the interpretation and enforcement of these Terms and Conditions.

12. Amendments to the Terms and Conditions

Majestic Silk reserves the right to amend or update these Terms and Conditions at any time. Should any changes occur, customers will be informed through a newsletter or email notification. We recommend that customers regularly review the Terms and Conditions to stay informed of any updates.

By continuing to use our services after changes have been communicated, the Customer agrees to be bound by the updated Terms and Conditions.
